Have you been injured at a theme park?

When visiting central Florida, it is hard to resist spending even a little time in one of our flagship attractions such as Disney, Universal Studios or even Fun Spot. Unfortunately, unfamiliarity with the park grounds, summer rains, construction and just bad luck can lead to visitors injuring themselves. These injuries are usually the result of slip, trip and falls. How do you know if your injury is the result of negligence on the part of the park?

Just because an injury occurs on park grounds does not mean that the park is automatically responsible. To establish whether there may be legal liability, an accident victim must prove the following:

  • The defendant has a duty to safeguard the premises by being the property owner or licensed operator;
  • The defendant was aware or should have been aware of a potentially hazardous condition, or, they were put on notice of such;
  • The condition on the premises was inherently dangerous and most likely unavoidable; and
  • The accident victim actually suffered substantial injuries.

It is important that if you are injured on the premises of a theme park that you take pictures of the scene where the accident occurred, take pictures of what caused the accident from multiple angles, take pictures of your injuries on the scene and report it to park staff. You should request an accident report form from the park and request the information of the on-duty supervisor, as well as the staff member who prepares the report. You should request copies of the surveillance video of where the accident took place at (you may not receive this but it is important to ask and document that you requested it) and you should request that if a piece of park equipment or scenery caused the accident, that the equipment in question not be destroyed. Most importantly, you should seek medical treatment the same day of the accident if possible.
