Is it too late to file my Hurricane Milton Claim?

Hurricane Milton made landfall near Siesta Key, Florida on October 9, 2024, as a category 3
hurricane. As hurricane Milton swept across the State of Florida, it left a path of destruction in
its wake. Even today, property owners are still trying to remedy the damage that was caused by
this storm.

Florida law imposes specific deadlines for filing property damage claims and supplemental
claims under property insurance policies. Fla. Stat. 627.70132 imposes a strict requirement
barring claims unless notice is given to the insurer within one year after the date of loss. This
deadline underscores the importance of promptly notifying insurers of property damage.
Once you report your claim to your insurance company, if more damage is discovered or
additional funds are needed, a supplemental claim can be submitted to the carrier. A
supplemental claim is defined as a claim for additional loss or damage from the same peril that
the insurer has previously adjusted or for which costs have been incurred while completing
repairs or replacement pursuant to an open claim. For supplemental claims, the deadline is 18
months after the date of loss under Fla. Stat. 627.70132. This timeline ensures that insurers are
notified of any additional damages in a timely manner, allowing for efficient resolution of
claims.
